While the Federal Government generally encourages the development and commercialization of innovation from its contracting community, all too often, the contractors are unaware of intellectual property protection necessary to operate in the commercial and non-commercial marketplaces. Stein, McEwen & Bui, LLP understands the contracting vehicles for a successful public-private partnership to best preserve our clients' research and development investments both in the commercial marketplace and in the world of Federal procurement. In addition, we also provide the following services for our clients, including, for example:
- Advising on the client's intellectual rights in regards to intellectual property developed relating to existing contracts, both between prime contractors and the Government and between prime contractors and subcontractors;
- Reviewing proposed contracting vehicles to determine which type of vehicle is appropriate for the client's intellectual property needs;
- Negotiating and drafting contractual provisions to effectuate the client's intellectual property needs; and
- Advising on compliance mechanisms and procedures needed to fulfill the requirements of the Bayh-Dole act as well as agency specific requirements.
